What Is “Close-out Netting” and Its Importance in Derivatives Law?

Close-out netting is a contractual provision allowing a non-defaulting party to immediately terminate all outstanding derivatives transactions with a defaulting counterparty. All positive and negative values are then aggregated into a single net payment obligation.

This is crucial as it legally reduces the credit exposure to a single, much smaller figure, minimizing potential loss in bankruptcy.
