What Is the Legal Status of Customer Assets in a CEX Bankruptcy?

The legal status is complex and depends on the jurisdiction and the exchange's terms of service. Generally, if the exchange commingled customer funds, the users are often treated as unsecured creditors.

This means their claim is subordinate to secured creditors and they may only recover a small percentage of their assets after a lengthy legal process. This reinforces the "not your keys" risk.
